Letter to FDA RE: Meeting of the Pharmacy Compounding Advisory Committee on Peptides

"We are writing with concern about the recent meeting of the Pharmacy Compounding Advisory Committee (PCAC or Advisory Committee), held on July 23-24, 2026, at which the Advisory Committee, in a series of close votes, chose to recommend six of seven peptides under consideration for inclusion on the 503A bulk drug substance compounding list (503A Bulks List). Not only do those substances pose a risk to public health and safety, but the Advisory Committee’s convening and vote, if followed by a corresponding rulemaking, violates established FDA criteria for listing new substances and is substantively and procedurally defective. "For years, the Agency has exercised appropriate caution with respect to these seven peptides. In September 2023, based on the available evidence (or lack thereof), the Agency issued an interim restriction placing these substances in Category 2, a designation for “Bulk Drug Substances that Raise Significant Safety Concerns.” This continues to be the view of expert Agency staff, who, in briefing materials made available to PCAC’s members, recommended against the listing of all seven peptides considered." One Year Later: How H.R. 1's SNAP Policy Changes Are Reverberating Across the Food System

In July 2025, the passage of H.R. 1, the “One Big Beautiful Bill Act,” set in motion the most consequential changes to the federal food safety net since its inception. For the more than 37 million Americans who count on the Supplemental Nutrition Assistance Program to meet their basic food needs, the law’s implications are wide-ranging, from restrictions on eligibility to cuts to monthly benefits. H.R. 1 also carries downstream effects beyond SNAP. It has consequences for participants in the Special Supplemental Nutrition Program for Women, Infants, and Children, federal school meals, Medicaid, and the emergency food system – and raises pointed questions about the administration’s parallel agendas to both reduce federal spending and improve Americans’ diets and health. CSPI's comment on USDA's final rule implementing the Whole Milk for Healthy Kids Act

USDA’s final rule Expanding Fluid Milk Options in Child Nutrition Programs (91 FR 25073) seeks to codify the Whole Milk for Healthy Kids Act, passed by Congress December 2025, and expand milk offerings to additional programs beyond NSLP, including SBP, CACFP and the Special Milk Program. In addition to providing these options, the rule exempts the saturated fat content in fluid milk from counting towards the weekly saturated fat limits school meals must follow. In this comment, we make the following points: 1. CSPI opposes USDA’s decisions to remove dairy fat restrictions from the CNPs and exempt fluid milk from school meal weekly saturated fat limits. 2. CSPI urges USDA to include and specify the nondairy beverage access provisions included in the Whole Milk for Healthy Kids Act in future rulemaking and ensure these provisions apply to all CNPs. 3. CSPI requests USDA clarify that any flavored milk options, regardless of fat content, must meet per-product added sugar limits and weekly added sugar limits as established in the final rule, Child Nutrition Programs: Meal Patterns Consistent With the 2020-2025 Dietary Guidelines for Americans.
